This is a working draft, not a published set of terms. It hasn't been reviewed by a lawyer yet - edit it here as that review happens, but don't rely on it or link it publicly until it has been.
Kwamua is a marketplace that connects customers who need a service done - roadside help, home repairs, cleaning, and similar informal/skilled work - with independent providers who offer it. Kwamua introduces the two parties; it is not a party to the service they agree to. We don't perform the work ourselves, we don't guarantee a provider's work, and we're not responsible for what happens once a customer and provider agree to a job.
You must be 18 or older, provide accurate information when registering, and keep your login credentials to yourself. You're responsible for activity that happens under your account.
Providers are independent businesses or individuals, not Kwamua employees, agents, or contractors. Kwamua doesn't set a provider's prices, doesn't direct how they do a job, doesn't provide their tools or vehicle, and doesn't guarantee them work. Verification (ID check) confirms identity - it is not a certification of a provider's skill, licensing, or safety record, and customers should exercise their own judgment.
Kwamua charges two things, both via M-Pesa: a small contact-unlock fee (paid by whichever side wants the other's phone number revealed for a booking) and a recurring subscription fee for providers to remain listed and receive requests.
The price of the actual job is agreed directly between the customer and the provider, outside the app. Kwamua doesn't process, hold, or take a cut of that payment, and isn't responsible for a dispute over it.
Either side can cancel a booking before it's completed. Repeated last-minute cancellations may affect an account's standing or lead to suspension.
Violating these can lead to a warning, suspension, or account termination.
Reviews must reflect a genuine experience with that booking. We may remove reviews that are fraudulent, abusive, or unrelated to the service provided.
Kwamua is provided "as is." We don't guarantee a provider will be available, that a job will meet any particular standard, or that the app will be free of errors or interruptions.
To the fullest extent the law allows, Kwamua and Adcoar Ltd aren't liable for any damage, injury, loss, or dispute arising from a service performed by a provider, from a customer's conduct, or from a vehicle or property involved in a booking. Kwamua's total liability for any claim relating to the app is limited to the fees you paid Kwamua directly (contact-unlock or subscription fees) in the three months before the claim.
You can delete your account at any time from the app. We can suspend or terminate an account that violates these terms, poses a safety risk, or is involved in fraud.
These terms are governed by the laws of Kenya, and any dispute is subject to the jurisdiction of the courts of Kenya.
